These terms apply when you use KinCanvas, the collaborative family-tree service at kincanvas.app. By creating an account or accepting an invitation, you agree to them. If you don’t agree, please don’t use the service.
1. What KinCanvas is
KinCanvas lets you build a family tree together with relatives. You can add people, link relationships, upload photos, and record short audio stories that we transcribe and use to suggest edits to the tree. Invited members of a tree share access to its contents.
2. Who can use it
You must be at least 16 years old to create an account. If you’re younger, you may only use KinCanvas with the permission and involvement of a parent or guardian. We don’t knowingly create accounts for children under 13.
3. Your account
You’re responsible for keeping access to your email secure, since that’s how you sign in. You’re responsible for everything done through your account. Tell us at the contact below if you suspect unauthorized access.
4. Your content
You keep ownership of everything you upload — profiles, photos, audio recordings, notes. By uploading content, you grant KinCanvas a non-exclusive, worldwide license to host, process, and display it to other members of the same tree, strictly for the purpose of running the service. We don’t sell your content, and we don’t use it to train AI models.
5. Information about other people
When you add a person to a tree, you may be entering information about someone who hasn’t signed up to KinCanvas — a living relative, a deceased ancestor, a minor. You confirm that, to the best of your knowledge:
- You have a reasonable basis (family connection, public records, consent, or another lawful ground) to include their information.
- You won’t add sensitive information (health, sexuality, religion, legal history) about a living adult without their consent.
- You’ll respect any request from a person mentioned to remove their information, where reasonable.
If a person asks us directly to remove their information from a tree they’re mentioned in, we’ll honor reasonable requests after verifying identity.
6. Acceptable use
You agree not to use KinCanvas to:
- Harass, defame, or doxx anyone.
- Upload content you don’t have the right to share, including copyrighted photos that aren’t yours.
- Attempt to bypass authentication, scrape other users’ trees, or interfere with the service.
- Use the service for commercial genealogy resale or any unlawful purpose.
7. AI-assisted features
KinCanvas includes an “oral history” feature that lets you record a short audio clip about a relative. The audio is uploaded to our storage, then sent to OpenAI for transcription and for extracting suggested edits to the tree. OpenAI processes the audio under its API data usage policies and does not use API-submitted content to train its models. Suggestions extracted from your recording are presented to you for review — nothing is applied to the tree without your explicit confirmation.
If you don’t want to use AI processing, simply don’t use the audio recording feature.
8. Invitations and shared trees
When you invite someone to a tree, the invitation link grants them access at the role you select (Editor or Viewer). Anyone who has the link can join. Treat invitation links like passwords — share them only with people you intend to give access. Owners can remove members at any time.
9. Service availability
We aim to keep KinCanvas reliable but don’t guarantee any specific uptime, response time, or feature continuity. The service is provided “as is” without warranties of any kind. We may add, change, or remove features as the product evolves.
10. Termination
You can delete your account at any time by contacting us. Deletion removes your profile and the trees you own; content in trees you don’t own remains with the owner. We may suspend or terminate accounts that violate these terms, or where we’re required to by law.
11. Limitation of liability
To the maximum extent permitted by law, KinCanvas and its operators are not liable for indirect, incidental, consequential, or punitive damages arising out of your use of the service. Our total liability for direct damages won’t exceed the amount you’ve paid us in the prior twelve months (which is currently zero, while the service is free).
12. Governing law
These terms are governed by the laws of [your state / country]. Disputes will be resolved in the courts of that jurisdiction unless you’re a consumer in a jurisdiction that requires otherwise.
13. Changes
We may update these terms occasionally. If we make a meaningful change we’ll notify you via email or an in-app notice and update the “Last updated” date above. Continued use of KinCanvas after a change means you accept the new terms.
